A prospective property purchaser, or the agent, may apply in writing to Council for a Section 64 certificate under the Noxious Weeds Act 1993.
This document will provide certification as to whether:
- there are any weed control notices affecting the property
- the amounts of any expenses due and payable in connection with any weed control notice
- the amount of any outstanding charges arising from the control of noxious weeds
A property purchaser must be aware that the Section 64 certificate does not provide certification as to the property’s general or existing noxious weed status. In this regard, the property may have current noxious weed infestations, however this certificate only relates to outstanding noxious weed control notices affecting the property.
